Whom do I file against after a hit-and-run car accident in California?

If you don't know who hit you, you have no one to file against. If you do know, you can file in Small Claims for up to $10,000. You can only recover that which was not covered by your insurance.

You should first file a police report. Then, you can go to your insurance company. If you were not insured, then you don't have much recourse, unless you have reliable witnesses.

Contact your insurer and file a claim under the uninsured motorist portion of your policy. This should cover the damage to your vehicle if your insurer decides you weren't liable.

You file against whoever you think is at fault. If you are not at fault, then you are in luck and don't have to file against yourself.
