What is the statute of limitations for arson in the state of New Jersey?

The statute for simple arson in NJ is five years. If there was loss of life, that is considered murder, and there is no statute. Be aware that there are often many legal ramifications attached to arson that may affect the statute, ie, if it is considered that firefighters, police or other civil personnel were put at risk.

For arson, and most other felonies (except for murder, manslaughter, certain official misconduct crimes, and certain crimes against children), New Jersey imposes a five year satute of limitations. That means that process (either an arrest or issurance of an arrest warrant) must occur within five years of the date of the commission of the felonious act.

From the time of the arson, the SOL is five years. There are exceptions, particularly if a fatality resulted from the arson or if the arsonist left the state.

The maximum you can server for an arson crime is 10 years. Now depending upon what county you are in will decide if you will be convicted to that maximum sentence or not.

Charges must be brought within five years of the dates of the arson. There are exceptions. If the suspect leaves the state, the five-year period stops until s/he returns. If a death is involved, there is no statute on murder. There are other considerations as well. If this is a concern, seek legal counsel.

If the crime in question is simple arson without other aggravating circumstances like a murder committed thereby, the applicable statute of limitations is 5 years. However, that time does not run while the alleged perpetrator has fled from justice.
