It goes down the list. Those most closely related to the departed receive all the benefits anytime there is no will.

When someone dies without a will (intestate), the estate is probated by the court, which will appoint an executor. Information about debts and obligations is assembled, as well as information about assets. The court makes sure that the obligations/debts are satisfied by the individual's assets before the residue is issued to the heirs.

When someone dies without a will, the probate judge will decide how to distribute the assets and debts to be paid in full. The probate judge decides everything and it might not be how the decedent nor their family would like. A will is essential to proper future planning and should not postponed indefinitely despite its distasteful nature. Accidents happen.
