When Spouse A leaves the home, does not intend to return and Spouse B is unable to determine the status of the marriage for the lack of contact or known whereabouts, this is considered abandonment. Different states have various rules regarding the conditions and amount of time of the absence.

Spousal abandonment/desertion isn't really a crime. Proof of abandonment is: separation of one spouse from another, with no intentions of resuming cohabitating, without other spouse's consent AND without justification.
