What is considered to be a legal withdrawal of money from a joint checking account?

I am going to leave my husband soon and would like to withdraw some money from our checking account.

You can withdraw from your checking account. You should consult an attorney, though. The funds are "marital assets" and must be shared, so take no more than half.

Legally, you may withdraw the entire amount since it is a joint checking account. As a practical matter, however the court will attempt to equitably divide all the debts and assets of the marriage. A checking account is just one of those things that has to be divided as well, so I suggest 1/2.

You should consult a lawyer first to see what you can take out, they would be able to tell you what you can take out, if you can take any money out of it.
