Offenses that can be charged as a felony OR misdemeanor are wobblers. A misdemeanor could be charged as a felony if you have a record. If you are convicted of a felony but not sentenced to prison, the court can change it to a misdemeanor. Not all offenses are wobblers.

A wobbler felony is a crime that can either be charged as a felony or a misdemeanor. It can also be a "low level" felony that gives an option of a fine or jail time instead of a prison sentence. Wobbler felonies are sometimes reduced at the time of a plea or sentencing.

I got a dui with priors which was a folney 22 years ago.After jail and probation I as went to court they reduced it to a wobbler .Afew years ago the F.B.I. i think cleared me to buy a gun so do you think the folney is gone. Thanks
