What can you tell me about pap smear malpractice?

My doctor missed a diagnosis in my pap smear.

Your Drs. office sends test collections to an independent lab for diagnosing, so if there were an error it would have come from there. Unfortunately, errors do occur from time to time, however, this doesn't fall into the category of malpractice per se.

Gynecologists and OBGYN doctors pay a large amount of money for malpractice insurance to protect them (personally) against malpractice claims. Contact your attorney or state health agency for malpractice details.

If you feel your doctor missed a diagnosis on your pap smear you need to obtain proof, once you have obtained proof you need to determine which lab they use and contact an attorney and file charges aganist the lab and doctor. The doctor relays on the lab to tell him about the findings.

If your doctor committed malpractice, it does not matter if it was from a pap smear or something else. Your state's laws for medical malpractice apply either way. Although these rules vary from state to state, you must generally show that your doctor deviated from the expected standard of care--just being wrong is not enough.

I don't think that this would vary much from any other malpractice case, misdiagnosis is not enough for malpractice suite in all cases, talk to lawyer.
