Your credit card agreement most likely stipulates that legal action can be taken for non-payment. If you are worried about debt, check out "Financial Peace" by Dave Ramsey for the best advice.

You can be sued for credit card debt. Seeking a judgement against a debtor is the last resort a creditor has to collect. If you are sued, you will be notified of the hearing date. You can go to court and protest the debt or show detailed evidence of why you are unable to pay. That's how to avoid judgment.

There is no guarantee that you will not be sued for credit card debt. Reasons that your may not be sued include: you have no assets or funds to pay the debt if your were sued, or there are bigger debts that already have claims to your funds and assets.

It will depend on the amount of debt that you have and whether you can negotiate with the credit card company to determine whether you will be sued or not. If you are making payments you will be okay. If you owe a large amount, they will attempt collection.
