Is it legal to sell copied CDs?

I bought a CD on eBay and it's a burned copy, not an original. I thought that was illegal.

That depends on who owns the rights to the CD. If it's a band/artist/group independant of a label, it might be legitimate. If it is a band/artist/group that's under copyright and distributed without consent of the rights holders, then that is a breach of copyright and probably illegal. Check back with the seller, and do some research on the artist.

Copyright law prevents an individual in the U.S. from burning copies of copyrighted material and selling them. It is a violation of federal laws. Notify the FBI and EBay.

Yes it is illegal; even a simple act as photocopying books are illegal, even downloading from limewire or frostwire, not unless you own the music then its not, otherwise, it is.

It is certainly a violation of copyright laws and could form the basis of a lawsuit. It may or may not be illegal depending on the jurisdiction.
