How old does someone have to be a legal guardian or at least be granted temporary guardianship?

I am concerned about my niece.

The law varies from state to state. You might check with the Family Court in your jurisdiction or contact CPS or an attorney for assistance.

In most states the legal age to assume parental custody of a child is 18, but of course this varies from state to state. Irregardless, if you're attempting to take parental control of your niece without her mother or father's consent i would say this is near impossible. The courts lean towards parents in even the most extreme cases.
