How is a new spouse's income relevant to my paying child support?

In most State's a spouse's income is NOT used to determine the non-custodial parent's child support obligations. The total child support is calculated on the earnings of the non-custodial parents. Some states also take into consideration the custodial parents income in determining the child support due to the custodial parent.

In all states but Massachusetts, a new spouse's income has no relevance on paying child support. The new spouse's income cannot be tapped to pay the prior spouse or children.
