You'll follow the same incorporation practices of any small business and your local business bureau can guide you in this. You are bound by the laws of not only the state you incorporate in, but the states that your business reaches, and federal. Delaware has the most liberal incorporation laws.

You incorporate your business in your state. Or you can incorporate in another state like Nevada with the necessary legal forms and proof of legal presence (mailing address, for example). Then you set up the website or add to the existing website the note of your incorporated name and any legal disclaimers.
