Tha Family and Medical Leave Act (FMLA) was expanded in January 2009 to include regulations to implement new military family leave entitlements, but is still in effect.

There is continuous FMLA leave, intermittent FMLA leave and recurring FMLA leave. An employer must provide the necessary paperwork to an employee who is qualified for FMLA when the employee makes the request.

You can only request up to 100 to 120 days for FMLA and you can request above and beyond that if need be. Your employer is not required to extend your FMLA beyond the initial period for which you requested it, they can choose to replace your position after that time.

FMLA states that an employee can take up to 13 weeks off of unpaid leave from a job for a medical reason - caring for sick relative, having a baby.
