Does a tenant have right to refuse extermination?

A tenant should be notified of scheduled extermination and given the option to refuse. An exterminator must have permission to enter if you are not home and then leave notice that he's been there, which is important if you have kids or pets. If you want to refused, unless there is an issue with the health department, that's your prerogative.

No. Standard leases have a provision for allowing the owner to conduct extermination. If the process would cause undue hardship for the tenants (ie: new baby in the house, house must be evacuated for an extended period of time, etc. ) then a court may ask the owner to postpone. However, there must be extenuating circumstances.

A tenant must have a verifiable health issue to refuse pest control services. If there is a proven health issue, the tenant must be most hygienic as to avoid pests.

There may be a good reason for a tenant to not want extermination, like allergic reactions or recent illness, and that should good enough not to exterminate. The tenant would have to put this in writing to notify the landlord of this situation. Every notification that is important between landlord and tenant should be in writing.
